Privacy Policy

Snark AI, Inc. ("we," "us," or "our") operates Mindblown AI, a service that creates playable games from the prompts you write. Mindblown AI is available through the Mindblown AI app and through messaging apps (together, the "Service"). This Privacy Policy explains what information we collect when you use the Service, why we collect it, who we share it with, and what rights you have over it.

By using Mindblown AI you agree to this Policy. If you do not agree, please do not use Mindblown.

1. Definitions

Account means the record we create so you can use Mindblown AI.

Generated Content means the games, code, artwork, audio, and other material Mindblown AI produces in response to your Prompts.

Personal Data means any information relating to an identified or identifiable individual.

Prompts mean the text and instructions you send to create or change a game, whether in the Mindblown AI app or through our bot on a messaging app.

Service Provider means a third party that processes information on our behalf, such as a hosting provider or payment processor.

Service means Mindblown AI, including any messaging app integration, website, or application through which we make it available.

Usage Data means information collected automatically about how you use the Service.

You means the individual using the Service.

2. Information We Collect

We collect information in two ways: information you provide to us directly, and information collected automatically through your use of the Service.

2.1 Information you provide to us directly

Account information. When you create an Account we collect the information you give us, such as your email address and username. If you sign in with your Google account, we receive your name, email address, profile picture, and Google account identifier.

Messaging app information. When you use Mindblown AI through a messaging app, we receive your account identifier, username, and language setting from that app. We do not receive your phone number or your messages with anyone other than us.

Prompts. Everything you send to Mindblown AI to create or edit a game, including follow-up instructions and revisions. Please do not include personal information, yours or anyone else's, in your Prompts. Prompts are reviewed by our automated safety systems and, where those systems flag something, by our staff.

Communications. What you send us when you contact support, report a bug, report content, or answer a survey.

Payment information. If you buy a subscription or credits, our payment processor collects your payment details. We receive your plan, billing country, the type of card used, and its last four digits. Full card numbers never reach our systems.

2.2 Information collected through your use of the Service

Generated Content. The games and assets Mindblown AI produces for you, including version history, so you can return to and continue editing your projects.

Activity information. The games you create, play, publish, share, or remix, the features you use, how long you spend on them, the number and type of generation requests you make, and error and crash logs.

Technical information. Your IP address, device type, operating system, browser type and version, time zone, language, and the date and time of your activity. From your IP address we derive an approximate location at country or city level. We do not collect precise location.

Safety information. The results of automated checks we run on Prompts and Generated Content, any human review that follows, reports submitted about content, and our record of enforcement actions and appeals.

Cookies. We use cookies and similar technologies for sign-in and security, to remember your preferences, and for analytics. See Section 8.

3. How We Use Your Information

We use the information described above to:

• generate the games you ask for, store them, and let you return to and edit them;
• create and secure your Account and let you recover access;
• operate Mindblown AI and let you publish, share, play, and remix games;
• process payments and refunds, and apply the limits of your plan;
• respond to your questions, bug reports, and content reports;
• keep Mindblown AI safe by checking Prompts and Generated Content against our Community Guidelines and the law, and by enforcing those Guidelines;
• detect and prevent fraud, abuse, and security incidents;
• operate, maintain, and improve our products, technology, and services, and to understand how people use Mindblown AI;
• send you messages about the Service, and occasional product news.
• comply with our legal obligations and enforce our Terms of Service.
• train and improve our AI models, products, and technology, using de-identified Prompts, Generated Content, and Usage Data with your account details and personal information removed; our staff may review this content as part of that work;
• keep de-identified Prompts after you delete your account, since they can no longer be linked to you;

If you would prefer we did not use your content to train our models, email privacy@mindblown.ai and we will exclude it.

4. Published Games Are Public

All games you publish on Mindblown AI are public at this time. Anyone can find and play them, including people who do not use Mindblown AI. The game's title, your username, its play count and likes, and your profile are visible to anyone. Comments and other content you post in public areas are public too.

When you play a game published by someone else, your username and your score in that game are visible to the person who published it and to other users.

Public content may be copied, shared, or indexed by search engines. We cannot control what others do with it once it is public, and we cannot guarantee that copies made by others will be removed when you unpublish.

You can unpublish a game at any time from your Account.

5. How We Share Your Information

We do not sell your personal information.

We share information in the following situations:

AI model providers. To generate games, we send your Prompts and, where needed, relevant parts of your existing project to third-party AI model providers. These providers process this information under contracts that limit their use of it to providing the service to us, and they do not use it to train their own models. We do not send them your name, email address, or payment information.

Service Providers. We share information, under confidentiality obligations, with the vendors that host, secure, and support Mindblown AI, process payments, deliver our messaging app integration, and help us analyze how the Service is used.

Other users. Content you publish is visible to anyone, as described in Section 4.

Legal requirements. We may disclose information where we believe in good faith that it is necessary to comply with a legal obligation, respond to a valid request from a public authority, protect the rights, property, or safety of Snark AI, Inc., our users, or the public, investigate suspected wrongdoing, or defend against legal claims. Where we are permitted to do so, we will try to notify you first.

Copyright and content reports. When someone submits a copyright notice or a content report about material you published, we may share your report or your response with the other party as the law requires.

Business transfers. If Snark AI, Inc. is involved in a merger, acquisition, financing, or sale of assets, your information may be transferred as part of that transaction.

6. Automated Decisions and Moderation

We use automated systems to review Prompts and Generated Content for material that breaks our Community Guidelines or the law. These systems can block a generation request, remove a published game, or restrict or suspend an Account.

If an automated decision significantly affects you, you have the right to ask for human review, to express your point of view, and to contest the decision. Contact us at privacy@mindblown.ai to do so.

7. Children and Parents

Mindblown AI is not intended for children under 13, or under the higher minimum age set by the law where you live. If you are under that age, please do not use Mindblown AI. If we learn that we have collected personal information from a child below that age without verifiable parental consent, we will delete it and close the account. If you are a parent or guardian and believe your child has given us information, contact us at privacy@mindblown.ai and we will remove it.

8. Cookies and Similar Technologies

We use essential cookies for sign-in, security, and preferences. These are required for the Service to work and cannot be turned off. We also use analytics cookies to understand how Mindblown AI is used; these load only after you accept them in our cookie banner. You can change your choice at any time through "Cookie Preferences."

9. Retention

We keep information for as long as we need it for the purposes in this Policy, and then delete or anonymize it.

• Account and Prompt data: kept while your Account is active.
• Generated Content: kept while your Account is active. Games you have published will become unavailable after you delete your Account.
• Payment records: kept for the period tax and accounting law requires.
• Safety and enforcement records: kept for 3 years so that we can enforce our Guidelines consistently and handle appeals.
• Usage Data: kept for 3 years, and longer where needed for security or where the law requires.

We may keep aggregated and de-identified information, which no longer identifies you, indefinitely, including content already used to train our models.

10. Where Your Information Is Stored

We are based in the United States and your information is stored and processed there.

Where we transfer personal information out of the EEA, the UK, or Switzerland to a country without an adequacy decision, we rely on Standard Contractual Clauses approved by the European Commission or the UK Government. You can request a copy by contacting us at privacy@mindblown.ai.

11. Security

We use industry-standard measures to protect your information, including encryption in transit and at rest, access controls, and monitoring. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

12. Your Rights

Depending on where you live, you may have the right to access, correct, delete, or receive a copy of your personal information, to object to or restrict how we use it, to withdraw consent, and to opt out of marketing.

To exercise any of these, email privacy@mindblown.ai. We may need to verify your identity first, and we respond within 30 days, or 45 days under California law. You will not be treated differently for exercising these rights. If you have a concern about how we handle your information, please contact us first so we can try to resolve it. You also have the right to complain to your local data protection authority.

EEA, UK, and Switzerland. We rely on the following legal bases: performance of our contract with you, to create your account, generate your games, and process payments; legitimate interests, to secure the Service, prevent fraud and abuse, moderate content, run analytics, and improve our products and technology; your consent, for marketing and non-essential cookies; and legal obligations, to respond to lawful requests and keep required records.

Snark AI, Inc. is the data controller for information processed through Mindblown AI.

California. We do not sell or share personal information as the CCPA and CPRA define those terms. We collect the categories of information described in Section 2, from the sources and for the purposes described there and in Section 3. California residents may request the categories and specific pieces of information we hold, where we got them, why we use them, and who we share them with, for the 12 months preceding the request.

13. Links to Other Services

Prompting runs inside third-party messaging apps. Your use of those apps and sites is governed by their own privacy policies, not this one. We have no control over their practices.

14. Changes to This Policy

Before any significant change to how we use or disclose your information takes effect, we will use reasonable efforts to notify you about the changes. If you do not agree to the updated Policy, please stop using the Service.
